Terms and Conditions

This is a summary of the information provided in the Mobility Mutual Trip Cover Documents.

When you book a trip with Uber Carshare, you’re responsible for returning the car to the Owner in the same condition you borrowed it in. You’re responsible for any loss or damage to the car during your trip - even if it wasn’t your fault.

Trip Cover offers protection for loss or damage that you are responsible for under the Uber Carshare Member Agreement. This includes:

  • Damage to the car you’ve booked
  • Loss of the car due to theft or fire
  • Towing, storage and recovery charges
  • Third party damage and loss

There are some exclusions to the cover. You may be responsible for the full cost of any loss or damage if you:

  • Use the car to tow anything
  • Drive off-road or on an unsealed surface
  • Drive through water or on the beach
  • Drive above the snow line during snow season
  • Put the wrong fuel in the car
  • Damage the underbody or the roof of the car by driving over or under something or putting things on the roof
  • Carry more passengers or cargo than the car is designed for
  • Drive for rideshare or courier services or competitive driving, or pick up hitch-hikers
  • Carry anything dangerous or illegal, or use the car in connection with any illegal activity
  • Use the car in a reckless or dangerous way or contravene traffic regulations
  • Drive while using a mobile phone or similar device (e.g. texting)
  • Drive with a warning light on or after becoming aware of a mechanical fault, or when the car is in an unsafe or unroadworthy condition
  • Drive under the influence of drugs or alcohol, or refuse to submit to a test
  • Leave the car unlocked or fail to secure the key in the Lockbox when returning the car
  • Jump start the car, or use it to jump start another car
  • Commit fraud or fail to provide information that is relevant to a damage claim
  • Flee the scene of an accident
  • Let anyone other than an approved Uber Carshare member drive the car
  • Don’t return the car within two hours after your trip’s end time.

To be eligible for cover you also need to:

  • report any damage or theft to us promptly;
  • get the details of any other parties in an accident and (if relevant) wait at the scene until police arrive; and
  • provide information and documents in relation to a claim.

Trip Cover doesn’t cover any loss or damage to your personal belongings in the car.

Full details of the exclusions are listed in the Trip Cover Protection Wording. If there is any difference between this summary and the full terms set out in the Trip Cover Protection Wording, then the Trip Cover Protection Wording will prevail.

You’re covered when you, or any other approved Uber Carshare member, is driving the car during a valid booking. If you let someone who’s not an approved member drive, then you won’t be covered.

It’s free to share the driving with another Uber Carshare member, as long as they are approved as a member before they drive and meet any age requirements the owner has set.

If the car has a manual transmission, all drivers must have at least two years’ manual driving experience.

Your Trip Cover applies for the booking period set out in this Protection Schedule, starting at the time you pick up the car and finishing when you end your trip.

If you don’t return the car on time, you may not be covered. Make sure to extend your trip in the app if you need more time.

If you’re responsible for damage or loss, you’ll be liable for the costs of:

  • damage to the vehicle that requires repair or replacement (excluding normal wear and tear)
  • loss arising from theft of the vehicle or fire damage to the vehicle
  • towing, storage and recovery charges
  • fees and charges relating to the assessment of the loss or damage
  • third party loss
  • a loss of use payment to the Owner for each day their car is unavailable

The most you’ll pay for these costs is your excess ($2000 with Basic Cover or $500 with Premium Cover), subject to your claim being accepted by Mobility Mutual. If any of the exclusions to cover (listed above) apply, you won’t be covered and will be liable for the full cost of repairs or replacement.

If you weren’t at fault in a third-party accident, you’ll pay your excess upfront and we’ll refund any costs we recover from the at-fault party. Be sure to get the contact details of any other drivers involved in an accident.

Damage cover for Uber Carshare trips is a financial risk product offered by Uber Carshare on behalf of Mobility Mutual.

When you book a trip with Uber Carshare, you also join Mobility Mutual. Your trip cost includes a contribution to the mutual for your cover and this is pooled with contributions from other Uber Carshare members.

Basic Cover gives you damage and loss protection during your trip, with a $2,000 excess. This includes:

  • Damage to the car you’ve booked

December 2023

The car was absolutely filthy - internal and external. Had to call the NRMA out 1hr after collecting the car as the car would not lock via the key fob or the car door lock. The boot would also not open. Whilst we were driving the car to our accommodation, the door locks were opening and closing intermittently locking us in- meaning an electrical issue. NRMA said the boot had been jammed and this was causing the car doors not to lock. The car fob is falling apart. The front left tyre feels heavy when driving and turning. The rego plate is bent. The car generally feels unsafe to drive. There was a parking fine already on the windscreen when we arrived. We returned it as soon as the NRMA had un- jammed the boot and submitted photo and video evidence to Uber.

Response from Charmaine

Thanks for bringing these issues to our attention Aaron. The car is blocked off for repairs and we’re sure you’ll be compensated by Uber for the trip and inconvenience. Context: Unfortunately the previous borrower to Aaron had caused damage to the keys (and apparently other areas of this car -according to Aaron’s above report), which they had not informed us about, which impacted Aaron's booking. We were away travelling at the time of both of these bookings and so could not check the car in person before Aaron's booking. Car share relies on borrowers informing owners of damage, as well as leaving the car in the condition they found it (or better). We checked the photos online, as we always do each week anyway, and no damage to the car was apparent. The previous borrower had not uploaded any photos of the damaged key nor mentioned it to us, nor had any borrowers prior to this suggested any issue - this car is hired regularly. Aaron's partner called us to troubleshoot the key, and asked if she could leave the car far from the homezone, in Lennox head, unlocked (because they couldn't lock it with the key fob, nor manually for some reason), as they needed to get to an event. We advised them that they could not leave the car unlocked in a different location (due to potential theft, damage etc that would become their insurance liability) and so they had 3 options: 1. They could either keep the car as long as they needed and seek compensation for the issues from uber, and take it back to the homezone to leave it there safely and locked in their own time, or 2. call roadside assist through uber (provided for free as part of the hire) to get the car back to the homezone, locked, cancel the car and pick up an alternative Uber carshare before their event. 3. get the car towed back to homezone if found to be dysfunctional by roadside assist. A really terrible circumstance for Aaron and his partner to navigate given that they had time pressures. We feel really disappointed in the prior borrower for not notifying us of the damage to the keys and the issue locking the car. We keep the car well maintained and always fix mechanical issues immediately because safety for everyone is a high priority for us. This was a difficult situation and never the experience we want someone to have with our car. We were grateful that Aaron brought this issue to our attention so we can fix it. Community car sharing is usually fantastic for everyone (cheap - this one $29 per day - personal cars shared) but occasionally people don't own up to damage they cause and treat the cars badly because they're not the $200 per day company hire cars that have end to end service with people on the ground to eyeball the damage whilst the borrowers are still there. The result being situations like this one - where owners are none the wiser until scenarios like this occur, which are terrible for all involved (their time, our time, their cost, our cost of repairs etc). We sincerely hope that Aaron and his partner found another great car to finish their trip with.
